New Gigabyte boards have a way of saving the current BIOS to an area of the harddrive you cannot access wgich is why formatting will have no effect. You need to enter the BIOS Q Flash utility and set it up to boot from the main BIOS not the backed up image, this is not the default setting so someone has been fiddling with your board before you bought it and if the person who sold it you has never heard of it he has no business reselling anything. Personally I would take it back and demand a refund as its not in a state fit for the purpose for which it was sold on the basis that A)It has been moved from factory settings by someone. B) That seller cannot possibly give you the support he's required by law to give you because he is a pratt. C) Finally I wouldn't mind betting you paid a lot more than the normal retail price, if it was more than Ł60 you've been ripped off for what is basically a second hand board, once someone has altered the default BIOS settings they must have had a CPU, RAM and a graphics card attached so the board is not new and there's no telling what long term damage may have been done by some idiot not using proper anti static precautions.

Just found this on the Gigabyte site:
Xpress Bios Rescue – Auto recovers damaged BIOS to its original state!
BIOS Image is stored in your HDD hidden area automatically when system boots up. Bios image is Indestructible by any software or viruses
